These Terms of Service ("Terms") govern your use of services provided by Bunbury Fencing ("Company", "we", "us"). By requesting, accepting a quote for, or allowing our team to perform fencing, installation, manufacture, or repair services at your property ("Services"), you agree to these Terms.
We provide fencing products and installation services, including but not limited to Colorbond fencing, swimming pool fencing, and picket fencing. All Services performed will be described in a written estimate, quote, proposal, or contract ("Proposal"). The Proposal sets out the scope, materials, colors, dimensions, pricing, and schedule for your project.
We will provide an estimated start date and timeframe. You must provide access to the property as required for performance of the Services. Delays caused by lack of access, permits, or utilities may result in schedule changes and additional costs.
It is your responsibility to obtain any required permits and ensure compliance with local regulations unless the Proposal states otherwise. For swimming pool fencing, we will install fencing to comply with applicable pool safety regulations where required; however, you remain responsible for verifying and maintaining compliance over time.
We supply materials described in the Proposal. All three fencing types are available in a range of colors, heights, gate hardware, locks, and latches. While we make best efforts to match specified colors and finishes, exact color matching may vary slightly from samples due to material and screen differences. Our workmanship includes professional finishing to protect against weathering and wear.
Safety is a primary design and installation goal. All installations follow industry best practices and applicable safety standards. For pool fences, we adhere to relevant pool-safety regulations at the time of installation. Hardware and gates are fitted to provide secure operation; ongoing safety checks and maintenance are the owner’s responsibility.
We provide limited warranties on materials and workmanship as detailed in the Proposal or separate warranty documents. Warranties may be limited by manufacturer terms for specific products (e.g., Colorbond). Warranties do not cover damage from: misuse, vandalism, acts of nature (including floods, earthquakes, or storms), normal wear and tear, lack of maintenance, or alterations by others.
Any changes to the scope of work requested after acceptance of the Proposal must be agreed in writing. Additional work or variations may incur extra charges and affect the schedule.
If you cancel or reschedule within the timeframe specified in the Proposal you may be liable for costs already incurred, including materials ordered and labour. We may also cancel or reschedule under circumstances such as unforeseen site conditions, extreme weather, or material shortages; we will notify you promptly and offer alternative arrangements.
To the fullest extent permitted by law, our liability for any claim arising from the Services is limited to the amount paid by you for the Services under the applicable Proposal. You agree to indemnify and hold us harmless from claims, damages, losses, or expenses resulting from your negligence, failure to follow instructions, third-party alterations, or misuse of the installed fence.
All drawings, designs, specifications, photographs, and documents created by the Company remain our intellectual property unless otherwise agreed in writing. You may not reproduce them for commercial use without our consent.
We collect and use personal information to provide the Services, prepare quotes, and communicate with you. Our use of personal data is governed by our Privacy Policy. By engaging our Services you consent to our collection and use of your personal information as described in that policy.
These Terms are governed by the laws of the jurisdiction where the work is performed. Any dispute arising in connection with these Terms will first be referred to mediation; if mediation fails, disputes will be resolved in the courts of the governing jurisdiction.
If any part of these Terms is found to be invalid or unenforceable, the remainder will continue in full force. These Terms, together with the Proposal and any other written agreements, constitute the entire agreement between you and the Company regarding the Services.
